Dispute Resolution

At MessengerFlow, we aim to provide a smooth experience for our users. However, in the event of a disagreement or dispute, the following resolution process applies.

Informal Resolution

If you have any concerns regarding our product, service, or billing, we encourage you to first contact our customer support team at [email protected]. We will do our best to resolve your issue informally through discussion.

Arbitration Agreement

Should the issue remain unresolved after informal discussions, you agree to resolve any disputes through binding arbitration. Arbitration will be administered by the American Arbitration Association (AAA) under its rules for commercial arbitration.

Governing Law and Jurisdiction

The arbitration will take place in New Jersey, USA, and will be conducted in English. The arbitration will be governed by the laws of the State of New Jersey, without regard to its conflict of law principles.

Waiver of Jury Trial and Class Action

By agreeing to these terms, you waive your right to a trial by jury or to participate in any class action or representative proceeding. Arbitration is the sole method for resolving disputes.

Binding Decision

The arbitrator's decision will be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

Exclusions

This arbitration agreement does not apply to any claims related to intellectual property rights, which may be resolved in court without arbitration.

Add-On Services and Consumables

Disputes related to Add-On Services, including managed proxies and other third-party resources provisioned through MessengerFlow, are subject to the same arbitration process described above. You acknowledge that Add-On Services are provisioned immediately upon payment and that MessengerFlow incurs non-recoverable costs with upstream providers.

Disputes must be raised directly with MessengerFlow prior to any chargeback or external dispute filing. Filing a chargeback without first attempting resolution through the process described herein constitutes a breach of these terms and may result in account termination and forfeiture of all active services.
